TERMS OF HIRE
GODIVA TRAVEL LTD Terms and Conditions
In the following terms and conditions, ‘the Company’ refers to
GODIVA TRAVEL LTD
1. Application
Our Standard Terms and Conditions apply equally for verbal or written contracts. The acts or omissions of the passengers are the hirers’ responsibility, and therefore any additional costs incurred for the performance of the contract rest entirely with the hirer irrespective of whether the hirer travels with the party.
2. Quotations
All quotations are valid for 7 days (providing the date of travel is more than 14 days ahead), unless agreed in writing at time of booking, and are given subject to GODIVA TRAVEL LTD having an appropriate vehicle available at the time the hirer accepts the quotation.
The given quotation is for driver and vehicle only.
It is the customer’s responsibility to check the booking confirmation for any errors and to notify GODIVA TRAVEL LTD accordingly. If this process does not take place the Company will not be held responsible for any ensuing problems.
3. Payment
A deposit of 30% must be made to secure a booking unless booked 7 days or less before the date of the journey, in which case full payment must be made at the time of booking.
All monies must be paid in full prior to the commencement of the journey. The booking will be cancelled if full payment is not received.
If any outstanding monies are due, the company reserves the right to collect the monies due from the original credit/debit card used by or for the hirer at any time.
The hirer also agrees that no chargeback will be raised to any credit/debit card issuing company with regards to the booking payment.
In the event that the deposit is not paid on time or the balance is not paid by the due date, the Company reserves the right to cancel the whole booking and any monies paid will be forfeited and the full balance will be due.
4. Surcharges
The quotation is given with regard to the operating costs at the time of the quotation. If more than 14 days elapse between the date of the quotation and its performance, the company reserves the right to pass on any increase in the cost of fuel or any other increased costs resulting from government action.
5. Extra Expenses, Damages and Soiling
GODIVA TRAVEL LTD reserves the right to retain a customer’s card details until the booking is completed in order to charge for expenses incurred that are not specified in the original booking and to recover any costs if the vehicle is soiled or damaged.
- Extra pick ups and drop offs
- Waiting time
- Unscheduled stops
The hirer is responsible for any damage or soiling caused to the vehicle by any passenger.
If the damage and soiling is of such an extent that the vehicle is out of service for any period of time, GODIVA TRAVEL LTD reserves the right to surcharge the hirer a minimum £500 a day or part of a day for which that vehicle is out of service.
6. Cancellation by Hirer
All cancellations must be made in writing. Cancellation refunds are based on the following:
- 21 days or more notice – 75% refund
- 14 days or more notice – 50% refund
- 7 days or more notice – 25% refund
- 1–7 days notice – no refund
Cancellation of an event, holiday, or reason for travel does not affect the hirer’s liability and the monies will remain due.
7. Cancellation by the Company
In the event of emergencies, unforeseen mechanical issues, or other unforeseen circumstances, the Company may cancel the contract and return all monies paid without liability.
However, GODIVA TRAVEL LTD will endeavour to provide alternative transport where possible.
8. Force Majeure
Neither party shall be liable for delays or defaults caused by circumstances beyond reasonable control including Acts of God, war, government restrictions, supplier failures, or transport disruptions.
9. Use of the Vehicle
The hirer cannot assume use of the vehicle between journeys unless agreed at booking.
Additional mileage, waiting time, tolls, parking, and ferry charges may incur extra charges.
10. Vehicle To Be Provided
Whilst every effort will be made to provide the booked vehicle, occasionally another equivalent or upgraded vehicle may be supplied due to operational circumstances.
If a different specification vehicle is supplied, liability will be limited to the difference in price.
11. Route
Unless specified at booking, routes taken will be at the discretion of the driver or company.
The Company cannot accept liability for passengers failing to follow agreed departure times.
12. Breakdown or Delay
Journey times cannot be guaranteed due to traffic, breakdowns, or unforeseen delays.
The Company is not liable for inconvenience or loss caused by delays.
Customers are advised to obtain appropriate travel insurance where timings are critical.
13. Seating Capacity
Drivers will not carry passengers exceeding the legal seating capacity of the vehicle.
14. Driver Hours
Drivers’ hours and rest periods are regulated by law and must be strictly adhered to.
The customer must follow all agreed collection times to avoid delays or journey alterations.
15. Property
The Company accepts no liability for loss or damage to property carried on or left in the vehicle.
Any found property must be collected by arrangement with the Company.
16. Passenger Conduct
The driver is responsible for vehicle safety and may remove abusive or disruptive passengers.
The hirer is responsible for passenger conduct and any damage caused during the hire.
17. Alcohol and Tobacco Consumption
All vehicles are strictly non-smoking. Alcohol is prohibited unless prior written permission has been granted by the Company director.
18. Hot Food and Drink
Hot food and drinks are not permitted without written permission from the Company director.
19. Animals
Except for guide dogs, animals are not permitted without prior approval.
20. Tours – UK and Europe
- Accommodation, meals, tickets, and administration charges already paid by the Company will be charged to the hirer.
- Passengers are responsible for passports, visas, and travel documentation.
- Passengers must comply with Duty Free and Duty Paid regulations.
- Travel insurance is highly recommended for all overseas travel.
21. Complaints
Complaints must be submitted in writing within 7 days of the completed booking.
GODIVA TRAVEL LTD will respond within six weeks.
22. Data Protection
All customer transactions are covered by data protection regulations.
23. English Law
These Terms and Conditions are governed by the laws of England and Wales.
By booking with GODIVA TRAVEL LTD the hirer agrees to these Terms and Conditions.
